    The material on this website and in ClaimSmart Group Inc. (“ClaimSmart,” “we,” “our,” “us”) inspection reports is provided for general information and homeowner guidance. It is not legal, engineering, architectural, or financial advice. Users should consult qualified professionals for any such advice.

  2. Scope of Observations
    All inspection findings are based on a limited, non-invasive, visual review of readily accessible areas on the date of inspection. Hidden or future conditions may exist that are beyond the inspector’s ability to discover without destructive testing.

  3. Tarion & Code Interpretation
    ClaimSmart inspectors reference Tarion’s Construction Performance Guidelines (CPG) and the Ontario Building Code (OBC). Final decisions on warranty coverage are made solely by Tarion Corporation; ClaimSmart cannot and does not guarantee acceptance of any claim.

  4. No Warranty or Guarantee
    ClaimSmart makes no representation, warranty, or guarantee—express or implied—regarding:
    a. Builder action or response to reported deficiencies;
    b. Tarion’s determination of coverage;
    c. Absence of future defects in the inspected property.

  5. Limitation of Liability
    To the fullest extent permitted by Ontario law, ClaimSmart’s total liability arising from any service, report, or website use shall not exceed the fee paid for the specific inspection giving rise to the claim.

 Terms & Conditions

 

1. Definitions

  • Client / Homeowner – The person(s) ordering an inspection.

  • Inspector – An individual engaged by ClaimSmart to perform inspections.

  • Report – The written results of an inspection, delivered electronically unless otherwise agreed.

2. Services Provided

ClaimSmart conducts Tarion-focused home inspections (30-Day, Mid-Year, Year-End, 2-Year, and 7-Year MSD) and delivers digital reports referencing Tarion CPG and OBC standards.

3. Inspector Relationship

Inspectors operate as independent professionals who have entered into written agreements with ClaimSmart to follow our Standard Operating Procedures (SOP), brand guidelines, and quality controls.

4. Booking & Payment

  • Inspections are scheduled online, by phone, or by email.

  • Payments are due on or before the inspection date unless otherwise stated.

  • Accepted forms: major credit cards, e-transfer, or approved invoicing.

5. Scope & Limitations

  • Inspection is visual, non-destructive, and does not include dismantling systems.

  • Only readily accessible areas are inspected.

  • Environmental testing (radon, asbestos, mold) is excluded unless specifically added.

  • The report is intended solely for the Client’s personal use in the Tarion warranty process.

6. Client Responsibilities

  • Provide safe, unobstructed access to all areas (including attic and crawlspaces, weather permitting).

  • Notify ClaimSmart of any known hazards in advance.

  • Review the report promptly and ask questions within five (5) business days.

7. Confidentiality & Data Use

ClaimSmart stores Client information in secure cloud systems and shares it only with the assigned inspector or as legally required.  See our Privacy Policy for full details.

8. Intellectual Property

All logos, templates, SOPs, and inspection reports remain the intellectual property of ClaimSmart.  Clients receive a non-transferable license to use their specific report for personal warranty purposes.

9. Cancellation & Rescheduling

  • Cancellations with < 24 hours’ notice may incur a fee (up to 50 % of the inspection price).

  • Weather-related rescheduling is permitted without penalty.

  • ClaimSmart reserves the right to cancel or reschedule due to inspector illness, unsafe site conditions, or force majeure events.

10. Limitation of Liability

ClaimSmart’s aggregate liability, including that of its inspectors, for any claim—whether in contract, tort, or otherwise—is limited to the amount actually paid for the inspection that is the subject of the claim.

11. Indemnification

Clients agree to indemnify and hold ClaimSmart and its inspectors harmless from any third-party claims arising out of misuse of the report or unauthorized alterations.

12. Governing Law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada as applicable.  Any disputes shall be submitted to the exclusive jurisdiction of the courts in Ontario.

13. Amendments

ClaimSmart may update these Terms & Conditions periodically. Continued use of our services after changes constitutes acceptance of the revised Terms.
